Employment Discrimination

Are you a victim of employment discrimination in New Jersey or Pennsylvania?

If so, we may be able to help. For 20 years, the Law Offices of Richard E. Yaskin has helped victims of employment discrimination recover their losses and vindicate the right to be evaluated based on merit.

Employment discrimination is prohibited with respect to categories that are “protected” under State or federal law. Examples of protected categories are race, sex, gender, sexual orientation, age, disability and pregnancy. However, not every category noted is protected under the laws of each state and our federal system.

One key to proving discriminatory treatment is to show differential treatment of “similarly situated” employees. Thus, paying a male more than a female employee for performing substantially similar work, retraining a younger employee while immediately terminating an older one for performance issues, or giving a warning and opportunity to avoid further misconduct to a white employee while immediately terminating a black employee are examples of potential discriminatory treatment. Even these seemingly clear cut examples, require an individualized assessment to determine if they are viable.

To prove status discrimination, an employee must typically show that the claimed reason for their firing was not the real reason, but rather a mere pretext to conceal discriminatory reason(s). From the very first consultation meeting, our office works carefully with clients to gather facts that either support or undermine a claim of discriminatory treatment.
